Terms and Conditions
Active Asia Cambodia (legal name: AAC Services), (‘we’ or ‘us’ or ‘our’) offers tours, holiday packages, and FIT (independent traveler) bookings including airport transfers, sightseeing tours, and hotel bookings in Cambodia.
Please read the following terms and conditions carefully because by making a reservation you accept and agree to be bound by the terms and conditions. The term ‘you’ or ‘client’ refers to you and to all travelers on whose behalf you make a reservation or booking with us.
1. The Booking
Your booking is subject to travel availability. It must be confirmed by us, by the issue of a confirmation of your booking, before legally binding obligations arise (the ‘booking confirmation’).
Upon confirmation from us, of your booking, you become legally obligated to pay for the said booking, unless canceled or amended within our allowable terms.
You are required to make full payment for your bookings upon receipt of our invoice and/or statement. Payment is processed in US Dollars. All fees or charges applied by your bank for the transaction are your responsibility.
We may require a copy of the passports of all travelers be sent to us after booking to ensure all names are correct.

- The prices quoted are subject to change and may be re-quoted until the time full payment is received and the booking is confirmed.
- After the booking is confirmed, price increases may occur by reason of factors outside our control which result in an increase in the cost of the product or service. Such factors include adverse fuel surcharges, taxes and airfare increases. We reserve the right to pass on these price increases.
- Airline surcharges and taxes are confirmed at the time your ticket is issued.
- International flights and other means of travel to and from your holiday country in order to join our tours are your responsibility to arrange.
2. Our Responsibility
We undertake to perform our services with due care and skill. When we book hotels, tour guides, transport operators and other service providers (our ‘service providers’) for you, we will exercise due care and skill to ensure they are suitable and that the information we provide you about our service providers is correct, accurate and up to date.
We take all reasonable care to ensure the quality and services of our provided services are suitable for use and provide your clients/travelers with reasonable quality and service as confirmed by us.
We regularly check and where possible inspect hotels, however, we cannot be held responsible if a service provider is unsuitable for a reason which we are not aware, or could not after reasonable inquiry become aware.
We rely upon our service providers to carry out the travel arrangements. You understand that the bookings we make with our service providers are made subject to the terms and conditions of our service providers. We do not accept any responsibility or liability for any injury, death, accident, delay, loss, damage or irregularity occurring, arising from or resulting from any act or omission caused by our service providers.
We are not responsible for any injury, death, accident, delay, loss, damage or irregularity occurring to you, or for any tour cancellation, arising from or resulting from any events outside of our control, including force majeure events such as acts of God, weather disruptions, detention, delays or expenses arising from quarantine, strike, theft, civil disturbance, terrorism, government restriction, strikes, riots or epidemics.
3. Your Responsibility
It is your responsibility to check the booking confirmation carefully to ensure that we have booked the correct tour, package or FIT arrangements and travel dates for you. There may be fees payable to make changes to tours, packages or travel dates and in many instances, such payments made may be non-refundable.
It is important that you provide us with the correct names of all travelers, exactly as they appear in their passports, to allow us to book hotels and any domestic flights that may be included in your tour package under the correct name(s). An amendment fee may be payable by you should tickets or booking confirmations be issued in an incorrect name if you have provided the incorrect name. Should an amendment not be possible, the cost of a new ticket or new booking will also be your responsibility. If ‘we’ are responsible for the issue of tickets or booking confirmations in the wrong name when you have provided the correct name(s), we will bear any amendment fee.
4. Cancellation by You
If you wish to cancel your tour, you must notify us in writing. We will then determine the cancellation fee and refunds applicable which will depend upon when we receive your notice.
For half and full-day sightseeing tours not part of a group tour or package holiday, cancellations are permitted up to 72 hours prior to the tour date. Within 72 hours of the tour date, your booking is non-refundable.
For small group tours and package holidays, the following cancellation rules apply.
A/ Cancellation more than 7 days before the start date – a per person cancellation fee of US$ 50 applies. All non-refundable charges for services, which may include any domestic air tickets, rail tickets or non-refundable hotel room nights, will be also be deducted from the tour price to be refunded.
B/ Cancellation less than 7 days before departure – No part of the tour price will be refunded.
Please note that: Once purchased for your tour, the domestic airfares within Cambodia on any tour may be non-refundable and there is also no refund for any unused travel arrangements after travel has started.
5. Flexibility
You should appreciate and acknowledge that the nature of travel in Asia, at times, requires flexibility when it comes to tours and sightseeing. You acknowledge that the route, schedules, itineraries, amenities and mode of transport may be subject to alteration without prior notice, due to local circumstances or events, which may include sickness, mechanical breakdown, flight cancellations, strikes, and events emanating from political disputes, entry or border difficulties, weather disruptions, safety and or other unpredictable or unforeseeable circumstances.
You acknowledge that levels of safety and comfort in some situations may differ from those that your clients/travellers are used too in their home country. Travel on any tour or package may include boat trips including access for getting onto and off local boats from riverbanks, lack of safety signage, quality and condition of footpaths and such places that do not offer the standard your clients/travellers may be used too due to laws and requirements in their home country. You accept and acknowledge that these are the local conditions and that we are not liable for any injury or accident due to local conditions.
You accept such alterations to our tours and will not hold us responsible for the loss of enjoyment, delays, extra charges or other compensation flowing from such change to arrangements. If you consider that the altered arrangements are not suitable for you, you may cancel your further participation in the tour, but cannot expect to receive any refund for unused tour arrangements, or compensation for amendment fees charged for amended travel arrangements.
6. Travel Documents
You are responsible to ensure your clients/travellers have the necessary travel documents (a valid passport and all requisite visas, permits, and insurance) to allow you to travel to and enter Cambodia. No claim can be made against us if your clients/travelers are denied entry into Cambodia.
7. Travel Insurance
We strongly recommend your clients/travelers take out comprehensive travel insurance, which should contain cover for: Cancelled or rescheduled Travel Arrangements (cancellation fees and lost deposits); Delayed or interrupted travel (and resumption); Loss of or damage to baggage, personal effects and travel documents; Medical, dental, pharmaceutical, hospital expenses (hospital cash allowance, repatriation, evacuation and medically assisted travel); Accidental death or permanent disability; and Personal liability.
8. Claims and Complaints
If you have a complaint about any service or product supplied by us, you must put in writing to us within 30 days of the end of the tour/package/booking.
9. General
Active Asia Cambodia (AAC Services) is based in and this agreement is governed by the laws of Cambodia. You hereby consent to the exclusive jurisdiction of Cambodia courts in all disputes arising out of or relating to the use of any bookings made or information provided.
